Conclusion of proceedings initiated by Decision No 40/2017. Adoption of “Methodologies and criteria to ensure equitable and non-discriminatory access to port infrastructures. First regulatory measures”.
By this decision the Authority adopted first regulatory measures to ensure equitable and non-discriminatory access to port infrastructures and the improvement of production efficiency with the aim of making the activities relating to the concession of port areas and docks and those concerning the authorization to carry out port operations and services as transparent as possible.
The measures provide for, among others, the identification and destination of port areas and docks, the awarding and duration of concessions, the introduction of incentive mechanisms, aimed at pursuing production and environmental management efficiency, to be taken into consideration in the determination of concession fees, regulatory accounting criteria that are oriented towards efficiency and equity, and criteria and procedures for issuing the relevant authorizations. On these measures the Competition Authority and the National Anti-Corruption Authority have delivered their opinion to the Authority.
The regulatory measures fall within the context of the provisions of Regulation (EC) No. 352 of 15 February 2017 setting out a regulatory framework for the provision of port services and common rules on port transparency.
